Justice rules out indications that US Attorney’s Office withheld images of Capitol assault

District Judge Tim Kelly has ruled out evidence that the prosecution was allegedly »withholding or suppressing» images from Capitol security cameras in connection with the Jan. 6, 2021, assault as the trial against members of the far-right Proud Boys group moves forward.

Tim Kelly has thus demolished much of the allegations of one of the main defendants, Dominic Pezzola, charged with conspiracy and sedition. In this sense, he defended that Pezzola’s legal team has had access to most of the images of that day since September 2021, enough time to be able to use them in the framework of the trial.

However, Kelly does not consider that there is enough material to exculpate the defendant, who helped to break through the police cordon set up that day. »Pezzola has not shown how this is related to him. (…) Nor has any evidence been suppressed. This court has dismissed this matter,» he pointed out.

In this way, the judge has put an end to some of the allegations made by the defense lawyers, who insist that the prosecutors »destroyed evidence» of the case and coerced to obtain false testimonies from other members of the movement.

Kelly has described Pezzola’s theories as »bizarre» and based on »conjecture» rather than credible evidence. »His premises are unsupported and his case cannot be defended,» he said.
