The White House has filed an appeal with the U.S. Supreme Court asking it to reject the Republican attempt to delay the end of the Trump-era border policy, known as Title 42, which was originally only supposed to be in effect until this Wednesday.
The White House’s request comes a day after the U.S. Supreme Court granted a petition filed by attorneys general from Texas and 18 other GOP-led states to uphold the rule, which allows authorities to immediately remove migrants from U.S. borders.
In this regard, the U.S. government has acknowledged that the end of Title 42 «will likely lead to disruptions and a temporary increase in illegal border crossings,» while reiterating its request to the Supreme Court to reject Republican efforts to lengthen the doctrine, as reported by CNN.
«The Administration in no way seeks to minimize the seriousness of that problem. But the solution to that immigration problem cannot be to extend indefinitely a public health measure that everyone now recognizes has outlived its public health justification,» the Justice Department said in a statement.
It has also defended that states do not have «the legal right» to challenge the opinion of a federal district court that struck down Trump’s border policy and ordered its termination before Wednesday.
Chief Justice John Roberts communicated the stay of the rule in a brief order on Monday, heeding the request of the attorneys general of Texas and 18 other conservative states.
Arizona Attorney General Mark Brnovich, who has taken up the states’ proposal, stated that «getting rid of Title 42 will recklessly and unnecessarily endanger more Americans and immigrants by exacerbating the catastrophe that is occurring at our southern border.»
He also estimated that illegal crossings will increase «from 7,000 per day to 18,000 per day,» according to CNN.
This judicial dispute comes days after the city of El Paso, Texas, declared a state of emergency in anticipation of a large influx of migrants following the repeal of Title 42.
In a statement, Mayor Oscar Leeser said that hundreds of migrants are on the streets «in unsafe conditions» as temperatures begin to drop.
