
The Subcommittee of Constitutional Accusations (SAC) of the Peruvian Congress has admitted Thursday a new constitutional complaint against former President Pedro Castillo for allegedly misinterpreting a decision of the Andean Parliament.
With 13 votes in favor, 6 against and no abstentions, the SAC will evaluate the constitutional accusation presented by the conservative bench of Avanza País, which also includes former Prime Minister Aníbal Torres and several members of his cabinet, including former Prime Minister Betssy Chávez, reported ‘La República’.
According to congresswoman Rosselli Amuruz, who has promoted the measure together with other congresswomen of the same party, the Executive gave an erroneous interpretation of the negative position of the Congress in relation to a question of confidence presented by the Government.
Specifically, according to Amuruz, the then Peruvian president stated that the Congress had rejected the question of confidence, when in fact the decision was not submitted to a vote of the Parliament, but rather it was directly the Chamber’s table that rejected to put it to a vote.
Because of this alleged interpretation, Avanza País accused almost the entire Government of violating the Constitution, considering that a constitutional infringement had been committed, since only the Congress would have the power to interpret the meaning of its decision, and not the Executive.
The events took place after the then Council of Ministers, presided by Aníbal Torres, proposed to reform the law regulating the calls for referendums, limiting ‘de facto’ the powers of the Parliament in favor of more frequent referendums among the population to carry out initiatives proposed by the Government.
Meanwhile, the SAC has already admitted a constitutional complaint filed by the Attorney General’s Office against the former Peruvian president in which he is accused of being the head of a criminal organization established within the Government.
According to the Prosecutor’s Office, Castillo would be the head of a criminal organization active in the Ministry of Transportation and Communications in complicity with Juan Silva, former Minister of this portfolio, with the former Minister of Housing Geiner Alvarado, as well as with officials of Provías Nacional and Provías Descentralizado, of the Presidential Office and businessmen and third parties, to favor the Tarata III Bridge consortium and other companies in public bidding processes.
