The Peruvian Supreme Court has denied the appeal filed by the legal defense of former president Pedro Castillo seeking to annul the investigation against him for allegedly committing the crime of rebellion and for which he is in preventive detention.
The issue presented by the former president’s lawyers pointed out that the Peruvian Congress did not follow a «regular» conduct because his defense would have been violated, as reported by ‘La República’.
The decision comes after a hearing was held on January 17 to review the issue presented by the former president, where for a moment Castillo could intervene.
«My right to defense and evidence was violated by this Congress of the Republic (…) Why would I have to leave the country? Where is the proof that I want to leave? I have not raped, robbed, or killed anyone. I never had the idea of leaving this country», said the former president in the hearing.
The Peruvian Judiciary has explained its refusal by assuring that the Andean Parliament followed the impeachment procedure foreseen in articles 99 and 100 of the Peruvian Constitution, according to the aforementioned media.
A FORMER MINISTER ASSUMES CASTILLO’S DEFENSE Former Minister of Defense Walter Ayala has assumed the defense of former president Pedro Castillo, who is serving 18 months in preventive detention in Barbadillo prison, on the outskirts of Lima.
In this way, Ayala has become the thirteenth lawyer of the former president since he announced the dissolution of the Congress and the establishment of an emergency government on December 7.
«I am defending President Castillo directly and I do not coordinate with any other lawyer, but directly with him. I am here to defend the issue of due process in the parliamentary seat. I am not here to seek Mr. Castillo’s freedom, but that the legislative resolution (of the motion of censure presented against him for moral incapacity) be declared null and void for having violated the due process», he reiterated on Monday to the radio station Exitosa.
